Terms & Conditions

Our Customer Service Department can take your order, answer your questions concerning product selection and availability, provide order status and authorize product returns. Call M-F, 0800-1630 Pacific Standard Time at (760) 724-8244 or (800) 854-2280.

Orders: All purchase orders are subject to acceptance by Pryor Products. P.O. terms of sale language that deviates from the Pryor Products Terms and Conditions specified in this section will not be recognized unless accepted in writing by an authorized representative of Pryor Products. Only the products, quantity, and specific shipping instructions requested by the customer’s P.O. will be acknowledged at Pryor, and only then if requested. Once accepted, any modifications to the P.O. regarding pricing, terms of sale or other specifics of the order shall not be made unless accepted in writing by an authorized representative of Pryor Products. Minimum orders are US$50.00.

Product: Pryor Products reserves the right at any time to make improvements in the construction, or modify the designs and specifications, of any product.

Prices: All prices are FOB (Free On Board) Pryor Products in Oceanside, California. Applicable taxes, shipping and handling costs are included on our invoice. Orders are subject to prices prevailing at date of shipment unless otherwise quoted. All quotations are subject to correction of clerical errors in calculation.

Payment: Standard terms of payment are net 30 days from date of invoice. Invoice date is shipment date. Delinquent accounts are subject to a service charge of 1.5% per month. Pryor Products owns the product until full payment is received from the customer. A minimum charge of $50.00 will be imposed upon dishonor of any check tendered in payment of goods purchased from us. Should additional costs and expenses (including attorney’s fees) be incurred as a result of any such nonpayment, this charge shall be increased accordingly.

Shipping: Pryor Products responsibility for delivery ceases when the transportation company accepts the shipment. If a shipment is lost or damaged, liability shall rest solely with the carrier, and it is the customer’s responsibility to make a claim directly to the carrier. Merchandise must be unpacked and inspected within 10 days after receipt, and any damage should be reported to the carrier within that period. Regarding shipments by air and/or export, there will be an extra charge related to any additional time and/or materials required for packaging modification.

Return Goods: No merchandise will be accepted for return without a Return Goods Authorization (RGA) number and agreement by Pryor to accept return. Contact our Customer Service Department for issuance of the RGA number. If authorized merchandise is returned in new condition, a charge will be made to cover handling and re-stocking. Items of special design as well as accessories and parts are not returnable.

Trial & Evaluation: Certain products are available on approval for clinical trial or evaluation for mutually agreed period of time. The customer pays all shipping charges, and is responsible for the full cost for loss or damage of products. Limited Warranty:

Period: One year from invoice date.

Warranty: During the one-year period, Pryor Products promises to repair or, at our option, replace a Pryor product free of charge if it is defective in materials or workmanship under normal use.  The customer must first deliver the unit to our plant at their expense.  No product will be accepted for return without prior authorization from Pryor Products.  Please call for a Return Goods Authorization Number before returning the product.

Exclusions: This warranty shall not apply to damage resulting from failure to use the product properly, accident, abuse or alteration.  PRYOR PRODUCTS SHALL NOT BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE SALE OR USE OF A PRYOR PRODUCT.

No Other Warranties: This limited warranty is the only warranty given by Pryor Products and is in lieu of any or all other warranties, expressed or implied, including warranties of merchantability and fitness for a particular purpose.  Pryor Products liability is limited to the repair or replacement described herein to the exclusion of other remedies and of incidental or consequential damages.  This warranty gives specific legal rights.  The customer may also have other rights which vary from state to state.

Warranty Registration: It is the responsibility of the customer to establish the warranty period by verifying the original invoice date.
